Tinjauan Hukum Islam Terhadap Praktik Jual Beli Akun Netflix (Studi Kasus Market place Shopee)

This research departs from the background of the rampant practice of buying and selling Netflix accounts on the Shopee market place. This study aims to find out how the practice of buying and selling Netflix accounts on the Shopee market place and the analysis of Islamic law on these practices. This research is library research, with a qualitative approach which is also a secondary research that is descriptive-analytical by collecting a number of literature data, sourced from literature books, journals, etc. The data is analyzed with content analysis and study analysis techniques. The results showed that the sale of a Netflix account on the Shopee market place is a rental contract because the account pin code is rented out every month. This practice is a C2C and B2B e-commerce transaction and consists of bay'ul musawamah, 'iwad} contracts, buying and selling with khiyar, wakalah, ijarah etc. Judging from the sale and purchase agreement, this practice is invalid because there are legal conditions that are not met, namely clarity of ownership of the object. When viewed in terms of ijarah contract, this practice contains a lease re-contract. When viewed from the side of maslahah mursalah, this practice has fulfilled the requirements of maslahah mursalah.
