Implementasi Maqoshid Syariah al-Syatibi dalam Tajdidun Nikah untuk Mencapai Rumah Tangga yang Harmonis

Abstract

This article explores the relevance of al-Syatibi's categorization of maslahah (welfare) in family life, focusing on tajdidun nikah (marital renewal). The study uses normative legal research, based on literature from books and journals related to al-Syatibi’s maqasid al-shariah and tajdidun nikah. Maslahah is categorized into three levels: dharuriyat (necessities), hajiyat (needs), and tahsiniyat (enhancements). The dharuriyat level addresses fundamental needs, such as spousal rights, protection of life, property, offspring, and religious education. The hajiyat level pertains to emotional, social, and financial aspects, ensuring the household functions smoothly without undue hardship. Meanwhile, tahsiniyat emphasizes aesthetics, comfort, and emotional well-being, enhancing overall family happiness. Tajdidun nikah plays a crucial role in revitalizing marital bonds. It aims to create a harmonious household filled with prosperity and blessings, aligning with the objectives of maqasid al-shariah. This renewal process emphasizes the importance of addressing both tangible and emotional needs to ensure the enduring success of a marriage. By integrating these principles, families can foster stronger, more fulfilling relationships and maintain harmony in their homes.
