Dampak Pembatalan Sepihak Setelah Persetujuan Nikah (Studi Kasus Pernikahan Mubarakah Pondok Pesantren Hidayatullah Balikpapan 2020)

Abstract

This research is motivated by a case that occurred at the Hidayatullah Islamic Boarding School Gunung Tembak Balikpapan, regarding unilateral cancellation after marriage approval in a mubarakah marriage. The cancellation was carried out by the woman on the grounds that the prospective husband to be paired with her did not meet the criteria. Through case descriptions and data analysis, it is known that unilateral cancellation of mubarakah marriages should not occur because in this case it is necessary to have a voiding sentence that can be accepted by the men. So that with the cancellation sentence received by the male side, it does not give a negative impression on the canceling party. It also does not have an impact on participants who are canceled, especially psychologically, they feel traumatized to participate in mubarakah marriages so that there is a grudge in their hearts towards those who have canceled unilaterally, as for the impact experienced by parties who cancel social discomfort.
